Clerk Signs Off on Novell's Costs In the Amount of $99,639.09
Thursday, April 23 2009 @ 04:48 PM EDT

The Chief Deputy Clerk has signed off on Novell's bill of costs, payable by SCO, in the amount of $99,639.09:

04/22/2009 - 595 - Costs Taxed in amount of $ 99,639.09 for Defendant against Plaintiff signed by Louise York, Chief Deputy Clerk 4/22/09 (jwt) (Entered: 04/23/2009)

If you recall, Novell asked for $124,331.70 originally and SCO had asked for a stay in even figuring the amount, but figure it they have, after SCO objected to $50,586.14 of the bills, and this is the final decision.

Well. At this level.

Two of SCO's four objections were sustained, and the amounts subtracted from the totals -- the hotel rooms rented for depositions and the costs for video syncing. So Novell will have to eat those expenses. But most of the costs were sustained. Now all Novell has to figure out is how to get SCO to actually pay them.

Add another 100k to the general unsecured legal claims
against the already under-water SCO group.

SCO Sues Novell for slander of Unix copyrights, and it all boils down to SCO
paying Novell just under $100K?

Is that the bottom line for SCO vs. Novell?

IANAL, but I watch actors play lawyers on television.
My thanks go out to PJ and the legal experts that make Groklaw great.

given that they were levied after the petition but based on a pre-petition action, do these costs get classified as pre-petition or post-petition?

Perhaps Novell should threaten to sue?
