Pacer Entries on Red Hat and a Letter to the Judge in AutoZone |

Both sides have sent their letters to Judge Sue Robinson in the Red Hat case, as they must every 90 days, to bring her up-to-date on what is happening in the IBM lawsuit. We have made arrangements to obtain those as soon as they are available to the public. Delaware has its own system, and until the judge reads them and releases them, they are not available. But, soon. Meanwhile, here is the Pacer entry:
1/3/05 46 Letter to Judge Robinson from J. Blumenfeld summarizing the status of SCO v. IBM case pending before the Honorable Dale A. Kimball in the USDC for the District of Utah (ft)
1/3/05 47 Letter to Judge Robinson from J. Ingersoll re status of various related litigation matters (ft)
In AutoZone news, there was a letter from SCO sent to the judge that the court received yesterday. It has been forwarded to the judge's chambers. It isn't on Pacer, and ex parte communications are not imaged the way a motion would be on receipt. Ex parte communications are frowned on in Nevada, I'm told, precisely because they are not in the normal, public loop. We'll have to wait to see what has happened, so this is just to let you know that something has happened. I know some of you have been tracking deadlines and have been wondering if SCO plans on moving forward or not in this matter.

I noticed on Tuxrocks that SCO's responses to IBM's third set of interrogatories
is attached to several filings as an exhibit and doesn't appear to be sealed.
I think this would be an interesting document to see (if possible of course) as
it deals with SCO's affirmative defenses

I feel sorry for the judge, who has to bear the burden of the verbiage of SCOG's
special pleading on his lonesome shoulders. On the other hand, he "asked
for it" when he denied AZ's motion to have the trial moved to Tennessee, so
my empathy for him is rather limited.
My remembrance is that AZ made some specific discovery requests to SCOG at the
beginning of the 90-day limited discovery period, and I am not up to date on
whether SCOG complied with any of them. It is not clear to me that SCOG made any
discovery - er, fishing - requests to AZ either: I suspect that SCOG made none,
or there would have been fireworks from AZ.[ Reply to This | # ]

Maybe sco found out that the judge runs linux and they're giving him/her thirty
days to purchase their SCOSource License or face litigation;-)
