There is yet another press release from SCO, announcing Tim Negris as "executive vice president of sales and marketing. In conjunction with this new assignment, Negris will assume responsibility for overall marketing and sales, and will oversee public relations, events, customer support, professional services, as well as direct and channel sales." Their PR could use some overseeing. And Darl? He's still there. He will "continue to lead the company's overall management team and drive the company's business strategies, while Negris oversees the company's operating units." So, I'd say Darl has lots more time for deep thoughts.
Here's the press release. By the way, in light of my last article, please note that SCO's own press release says "UNIX and UnixWare are registered trademarks of The Open Group." And as you read the description of the company, I think we see the Negris touch already in this sentence: "SCO's highly innovative and reliable solutions help millions of customers grow their businesses everyday, from SCO OpenServer on main street to UnixWare on Wall Street, and beyond. " I don't know that innovative is the first word I'd think of to describe SCO products but you have to admit that sentence is good marketing.

Tim Negris and Sandy Gupta seem to have all of the responsibility that belonged
to Jeff Hunsaker two years ago. What is Jeff Hunsaker doing now?

Does this seem like a "preparation to exit" the business for McBride?
This really looks like it is beginning to sideline his responsibilities. I sort
of expect another reassignment in a week or so. Something like "exploring
innovative projects..."
Followed a month or so later with "..We thank D. McBride for all the work

That statement is probably meant to
make investors think that they run the stock exchange, but it's probably only
really true because the McDonalds on Wall Street use it on their tills.
Still be a factual statement mind you ;)

The story
lead:
Darl McBride looks 20 years older than the last time I
saw him four years
ago.
.....
And don't forget about IBM executives
making good on their threat to darken

It's almost enough to make you
feel sorry for McBride, until you realize he

Lousy
diction. "Prior to joining SCO..." is correct.
Meanwhile, I find it
interesting that they bring in someone who worked for their arch-enemy. Perhaps
SCO hopes to gain some insight into how Big Blue operates? Personally, I can't
imagine working for a company so (rightfully) villified. The guy either failed
to perform his own due diligence, dislikes IBM, or, gasp, horror, actually buys

In fairness to SCO, the attribution of UNIX and UnixWare
being registered trademarks of The Open Group is contained in SCO press releases

I know that we have seen the PIPE fairy come and go for SCO in recent times
however the rapid transitions at the executive levels where it is almost a shell
game in any given month exactly whether or not an executive still holds the same
responsibility is one of the biggest signs of a company in very poor financial
condition.
Given the executive shuffle, the progress (or absolute and complete lack
thereof) in the IBM matter, the challenges of ownership in terms of actual
rights transfer attendant to claims of ownership and enforcement, and the
rapidly declining revenue stream as customers continue to desert SCO at a rapid
pace, I again question how SCO can continue to issue and file statements with
investors without filing the standard text as to the risk to the business as a

There's an English usage error in SCO's "About SCO" piece that grates
against my sensibilities every time I read it. As it's SCO's, however, I feel
totally disinclined to point out what it is.

The word "innovative" in SCOG's corporate mouth conjures up the word
"terror" in my mind: terror as the weapon of the weak, the desperate,
the ruthless and the clueless. Terror works until the targets of terror are sick
and tired of living in fear, and would rather take the risk of dying to remove
the fear from their lives.
At that point, those who would inflict terror realize that terror is at best a
two-edged weapon and at worst, that two can dance this grisly tango.

I thought at the begining of this, when Groklaw was still at Radio Userland that
SCO either had something, or that they believed they had something. As more
information surfaced, it became clearer that they had little, it anything, and
the most recent stories have made it abundantly clear that they had nothing at
all, and have known it from the start.
To me this screams of fraud at the very minimum.
Now I am not a lawyer, nor am am I a law enforcement professional - I'm a
salesman. But with all of the information that has been gathered by PJ and the
rest of us (mostly by PJ though - she's done a wonderfull job and I'd kiss her
if my wife wouldn't kill me <G>) is there not now enough information for
criminal charges to be laid?
Darl McBride at least would appear to be terribly exposed, as would Chris Sontag
and Darcy Mott. Raalph Yarro may also be exposed (though he isn't an executive,
he is on the board, and the board had to have some involvement).
Would it be possible to summarize the information and sources from Groklaw, and
hand it to the police so they could evaluate the possibility?

So there's this old, old expression, "Re-arranging Deck Chairs on the
Titanic..." which is a euphamism for "carrying on regardless even well
all hope is lost".
It may be unkind of me to suggest that TSG have reached a point of no return, or
that their present rate of cash burn makes impending doom inevitable, but we'd
all have to admit that things do not look good.
So I thought it might be interesting to start a thread here and see if we can
think up some reasons about why Darl McBride would delegate more of the sales,
marketing and day-to-day operations of TSG to someone else. See if you can
expand or extend the list with me...
1. Shareholders.
It's an obvious start. Perhaps enough influential shareholders got together and
told the company's management team that they had finally [duh] realised that
Darl was a liability and that they wanted him to take a back seat in the public
relations, sales and marketing areas. Kind of a damage limitation exercise, if
you like.
2. Cash Burn.
Maybe our new face is a loyal friend of the current directors of the company.
Perhaps they thought that it would be nice for him to be paid a directorial
salary and bonus from the dwindling cash reserves, before anyone else gets their
hands on the money.
3. Darl's Busy.
So this is harder to assess. Over the last few years we have gently [and not so
gently] poked some fun at Darl McBride, his intelligence and wisdom for leading
his company down the paths he has chosen. I think it's fair to say, however,
that he has a survival instinct. Whatever he feels, personally, for the chances
of this company to survive the multiple legal attacks and evapourating business
income, Darl will want to make sure that he, personally, survives. So he'll want
to pop up somewhere else with a new company and a new business. [Actually, that
makes me kinda nervous]. But perhaps Darl needs more time away from The Good
Ship TSG in order to complete his parachute and set up one or more new business
ventures?
We might be able to do a little research into this third theory. Maybe someone
could take a look and find out if he holds a directorship in any other
companies? Or perhaps the other directors might?
4. Time Off
Well, obviously the poor guy has been seriously busy these last couple of years.
Maybe he felt it was time to share the workload a little and not over-do things
at the office quite so much.

data between sources by developing the core of Me Inc., which SCO calls the Edge

Old AT&T developed a remote access server in
1993 that was called the Edge Vehicle. It was used for years as a
means of exchanging data between sources for its successful WorldNet service.
That project had no relation to USL.
Even greater irony: The prototypes
were based on a binary USL Unix version that was renamed Unixware after
the Novell merger
A law firm like BSF could have a field day suing a
