SCO has put out a press release, which lets us know what the teleconference today is about. It is about EdgeClick, "a new technology platform for mobile and desktop digital services," which the release claims the company has been developing inhouse "for several years."

SCO says you can make oodles and boodles of money if you bring them subscribers to Me Inc.:

Becoming a Me Inc. Sales Agent requires no technical skills or training and no investment other than a smart phone and a subscription to Me Inc. digital services. With these two simple things, a sales agent can earn up to hundreds or thousands of dollars per sale in commissions and subscription annuities generated by each account they sign up.

Provo City Mayor Lewis K. Billings, says he's using Me Inc. to bless the residents there:

"One of my main goals as the mayor of Provo City is to use technology to bless the lives of Provo residents, and Me Inc. is simply and effectively allowing me to do that," said Lewis K. Billings, mayor of Provo, Utah. "Me Inc. is an incredible technology, one which I plan to use continually throughout my term as it dramatically enhances my ability to personally reach constituents."

There is truly nothing I can add to that which isn't already bursting and cascading inside your brains like fireworks on the 4th of July. So there you have it. A wonderful business opportunity for you. As for me, my irony meter has exploded, which makes it impossible for me personally to accept.

Thank goodness SCO is going to make squillions from their ME venture! For a
while there I was worried SCO would not have the squillions needed to pay for
IBM counterclaims damages. Phew, crisis over. :-)

This is my first post to Groklaw after years of lurking in the background and I
never in a million years thought it would be in support of SCO. Hell has
certainly frozen over...

Anyway, I think we need to remember what we are doing here on Groklaw. As I
understand it we are trying to be objective and to understand the SCO case. I
know, my head hurts as well trying to fathom out what SCO are doing in suing
IBM, but if we want to simply shout at SCO without thinking moreabout ME Inc
then I suggest people head over to Slashdot and do it there.

What SCO are propopsing in ME Inc and Edg Click isn't new but it is viable. Just
because it's SCO doesn't necessarily mean it's the same old nonsense being
trotted out.

I wonder if I'm mellowing in my old age because SCO is now the underdog and we
British hate to see this sort of abuse going on?

Anyway, just because it's SCO doesn't mean we should blindly ignore it.

Just my 2p worth for the day. I'll now crawl back under my stone for the next
few years and await the abuse for sticking up for SCO.

On the other hand, Asterisk, the Open Source PBX, has been downloaded at least
200000 times, while EdgeClick has just one beta test to its credit. You're
killing me, Darl.

This is an open question: are there Open Source technologies that are in the
same niche as EdgeClick? I wouldn't dare ask for "same functionality",
because marketing types have been known to grossly exaggerate the funtionality
of their products.

Many years ago I shared a house in the UK with three other couples. Bit by bit
we rebuilt the property until it was a lot more habitable and one of the last
jobs was getting double-glazed windows fitted. One evening I sat there whilst a
double-glazing salesman told me (with a perfectly straight face) that his
companies windows were already fitted to Buckingham Palace and in the next few
weeks Sir Richard Branson would be having a set fitted to his yacht. Ummmm, how
can I put this, the 'bull excrement' light above his head was so bright it hurt
the eyes.

Reading the statement above about the latest SCO money making opportunity caused
a similar light to come on, it's bright enough to read by.

Look into the SCO/Canopy board of directors ... I think some of them have been into MLM marketing. AFAIR, it was NUSKIN.

Utah and MLM

"Nature's Sunshine Products, of Spanish Fork, Utah, markets herbs, vitamins, other nutritional supplements, homeopathic remedies, skin and hair-care products, water treatment systems, cooking utensils, and a weight-loss plan. Its more than 400 products include many that are claimed to "nourish" or "support" various body organs. Its salespeople, dubbed "Natural Health Counselors," are taught to use iridology (a bogus diagnostic procedure in which the eyes are examined), applied kinesiology (a bogus muscle-testing procedure), and other dubious methods to convince people that they need the products.

Nu Skin International, Inc., of Provo, Utah, sells body-care products and dietary supplements. Nu Skin's Interior Design division markets expensive antioxidant, phytochemical, and "active enzyme" products. The enzyme products are said to be important because "the majority of cooked or processed foods we eat lack an ideal level of enzyme activity" needed for digestion. This statement is nonsense because the enzymes needed for digestion are made by the body's digestive organs. In 1993, the company and three of its distributors agreed to pay a total of $1,225,000 to settle FTC charges that they made unsubstantiated claims for Nutriol Hair Fitness Preparation and two skin-care products. In 1997, the company agreed to pay $1.5 million to settle charges that it had made unsubstantiated claims for five more of its products. The products, which contained chromium picolinate and L-carnitine were falsely claimed to reduce fat, increase metabolism, and preserve or build muscle."

Greetings,

This sounds an aweful lot like AT&T's Edge / UMTS services and Verizon's Wireless Networking Services. Based on where this is happening and the wording of the article, I suspect that SCO is simply extending out the old Amway Data Network (ADN) and stealing some of their marketing / sales plans.

Is not common knowledge, but Amway used to have one of the largest and fastest data networks on the planet. There was talk about 15 years ago of merging their network with their small Cell Phone network to create what AT&T and Verizon are now selling. Additionally, Microsoft attempted to do something very like this in the mid-90's when they started trying to aquire a number of cell phone network service providers. Microsoft's attempt was actually blocked by the Clinton administration at the strong urging of Al Gore.

Assuming for a moment that the theory of Microsoft / TSG partnership is correct, then I see this as a way for Microsoft to achieve what they were denied by the US government previously through the use of their sock puppets. While at the same time giving the old Amway folx what they wanted and a boat load of cash to boot.

It is just that; something SCO made up and released to the press. Google finds no other mention of the quotation by Lewis K. Billings, mayor of Provo, Utah. But read Benefits of a Community Broadband Network Speech before the American Public Power Association Community Broadband Conference (scroll down a bit for correct speech) to see what kind of man he is when it comes to technology. He at least understands enough to employ a decent speech writer.

What are we actually told about this little sales spiel for Me Inc? Only that he is one of the early adopters of Me Inc. digital services. He sounds as if he is making a speech, but not a public one (or it would be on the Internet). Let me guess, he was given/loaned the wherewithall by SCO (perhaps without their name even being mentioned) and being a technology enthusiast, has made good use of it and has been 'set-up' to make a speech at some 'private' gathering about how he got on with it. What we read is possibly a closing remark.

Well that's my theory, alternatively, do you believe anything SCO says?

Well of course IBM don't want SCO, they could have had them years ago - might
even be what SCO were aiming for. More knowldegeable folk than I seem to think
so. But in the event that SCO produce anything of value they might be interested
in trousering that before the rest goes to the liquidator.

After a visit to edgclickpark.com I'm completely underwhelmed.

Only two apps available, shout and vote, and only for the Treo.

I particularly like 'vote' where you can become "a truly active
listener" by spamming people with opinion polls.

The rest of the links all are aimed at getting you to sign up to provide apps,
develop apps, sell services, etc.

I'll not be going back.

... at what they are actually offering, and can say that they have failed miserably to achieve what was promised about 9 months ago. It was supposed to be a fairly comprehensive servive, which people would run on an "edge" server connected to their own network, and would be able to do lots of powerful admin type things. The preview had about 12 or even 15 icons on the screen, for different things. Also it was supposed to run on many more devices than just the Treo. The whole thing was going to be sold through their existing resellers, because expertise in customising, installing, and configuring it was clearly necessary.

But today we have a very minimal subscription service with only two applications available, "Shout" and "Vote", and nothing whatsoever remarkable about either of them.

I guess that they ran into development problems, perhaps their one remaining developer, Mr. Gupta, has been too busy doing other things?

Over the last several years, SCO has demonstrated that doing business with them is practically begging to be sued.

SCO has demonstrated that they are quite cheerful about taking either former business partners (such as IBM) or former customers (such as AutoZone and Daimer-Chrysler) and dragging them into court, years after the business relationship has ended, over violations of tiny minutae-- real or imagined-- of some long-past contract or license.

In fact-- surprising for such a litigation-driven company-- it appears former customers or business partners are the only people SCO sues.

With all this in mind, who in their right mind would possibly sign up for SCO's newly announced business proposal??? It seems to me that anyone who gets themselves involved with EdgeClick/Me Inc is placing themselves at serious risk of getting unexpectedly sued several years later for some arcane reason.

'SHOUT' service from the Me Inc. link of the Edge Click Park mentioned in the press release: " Use Shout for broadcasting any kind of voice message or pre-recorded audio message up to one minute long. Announcements, updates, alerts, instructions, motivational messagesā€”whatever gets the job done."

I saw that and, while I don't normally doubt anything PJ says, I had to go to the original and confirm it. Yes, there it is in the original "Me(TM)". It then struck me that if anybody had a right to trademark "Me" it would be Microsoft so I checked the list. "Windows NT" is there as is "Windows Vista" but no sign of the tour de force that was "Windows Me".

What I'd like to know is whether we'll all have to add (TM) whenever we talk about ourselves in future. :-)

I read a number of comments and somehow did not see some assumptions I think we
are sharing:

Given SCO's recent manpower, are we assuming there's a limit to what they could
develop this year? Do we suspect they aren't offering a lot of new software? Do
we worry that whatever glue (among disparate devices) this new system has, in
inadequately shaken down for the level of security they claim? Do we suspect
that the lack of solid beta test reports and satisfied customer reports indicate
the new product could be pretty raw?

And to restate the other bit of obviousness, which has certainly been
mentioned:

This new product seems to require people to write customized software, to
benefit from the connections SCO is offering. So how come sales people need no
previous skill to sell it well? Might they at least need to be good at
specifying requirements???

However, I've got disagree with the people who ask, "Would you do buisiness
with a company that sues it customers (and might sue you)?" As a
consultant, I've done that many times, and here I am, telling the tale.

I have recently been working in an organisation where the most senior management
seemed to be on a mission to create the biggest, most momentous business failure
of all time. You fight and kick and struggle to try to get some kind of warning
through the various ranks above you but, even though some/many will agree, the
'Yes men' mentality forms an impenetrable barrier to reason.

I was seriously thinking I'd have to leave the job until a business
reorganisation split my area off seperating us from this floundering Titanic.

It makes me think of the poor SCO engineers and other actually productive people
who are hitched to this steaming stinking pile but are fighting to actually do
something right. Unfortunately, even if they leave, how would their resume look
to you Groklawyers; "worked 10 years for Caldera/SCO."

Does the term "barge pole" spring to mind?

I read the press release twice and still don't get what "EdgeClick"
actually is.

It allows information to go out to "edge" devices. A distribution
company used it to get data entry from the field.

I can think of dozens of technologies that can be used in various combinations
to do such simple data transfer "things" like this. What'd they do,
repackage/build a javascript library or something? What the heck is it? Anyone
know how to translate the buzz-word babble?

Let's assume, for the sake of discussion, that SCO has actually come up with
something original and worthwhile. Where are they going to find developers to
write for it?

Developers who are familiar with SCO's expansive defintion of "derivative
works" should be deathly afraid of going anywhere near SCO's "IP"
for fear that contact might contaminate them and severely limit their future
employability.

Companies considering parterships to develop for this platform would likewise do
well to examine the statements SCO has made in their various lawsuits and ask
themselves if they relish the idea of being defendants in future lawsuits.

Even if SCO has created something worthwhile, I think it's dead on arrival
because of SCO's history.

As for me, my irony meter has exploded, which makes it impossible for me personally to accept.

I sincerely hope that no one was injured in the blast. What are the warning signs that one's irony meter is about to go ballistic? perhaps a protocol can be worked up to minimize the effects of other such blasts.

What does this groundbreaking, world-changing, buzzword-producing technology do
right now? You can broadcast audio messages, or take instant polls with a lot
of people (with "browser-based devices") and supposedly not a lot of
effort.

That's it. (At least all I can see.)

I described the entire service, as it currently exists, in a single sentence.
Maybe they have technology to do something more impressive, but the service as
it exists now I don't think is going to turn SCO's fortunes around.

People have been commenting on the buzzwords and general lack of content in
press release. I am going to stick my neck out (with accompanying invitation to
chop my head off) and say that I do not believe SCO has any real product at all
in Me Inc.

What hard facts have I been able to gleen from the published information?

Well Me Inc runs on all sorts of web-enabled mobile devices and phones; but
actually only one particular mobile phone at the moment. And only on three
particular phone networks.

It has great features like SHOUT and VOTE and err...

It involves a thing called an 'Edge Server' but what it is, what software it
runs, is never explained. But as the only functions of the system are SHOUT and
VOTE (and err...) this probably does not matter.

They do give one 'success story' Musco Food Corp. but this seems to be some sort
of custom job and it is hard to see any conection with the Me Inc product -
certainly no SHOUT or VOTE.

Involves using an Excel spreadsheet. Cannot see how this fits in with SCO UNIX,
Samba perhaps?

SCO require OTHERS to:
Make, supply, and maintain the mobile phones.
Supply and run the wireless infrastructure.
Write the software.
Sell the product.
(I have omitted the 'Edge Server' because I have not a clue where that comes
into it.)

In short, I do not beleive that they have a product. Now tell me that I am
wrong.

I don't know if it has been pointed out already,
but the phrase "Me Inc." is as far as I can see
literally the same as the german "Ich-AG".

"Ich-AG" is the name for a programme to reduce
the massive unemployment here. Roughly is a set
of simplified rules and government aids applying
to unemployed who decide to go self-employed.

It is something definitely *not* associated with
great personal success or wealth.

Ok, I admit, I haven't been following this soap opera as much as as I used to, but does anyone else find it odd how completely and utterly Rob Enderle has turned on McBride & Co.?
However, analyst Rob Enderle said it was unlikely that strategy will work, not with the tens of millions of dollars the tiny company has already spent on its bid to collect on alleged Unix-Linux copyright and licensing issues. "Because the litigation has become so much of what they are, the lawsuits tend to eclipse anything else they try to do," Enderle said. "And if it goes bad for them with IBM, I doubt anything they do with software will be able to save them."
Compare with his rabid statements of the previous year... my only conclusion is that they stiffed him on his invoice for shilling services, and he's taken it personally. Or perhaps he has a new paymaster?! (previous backers cleaning up their mess). I'm not very creative with conspiracy theories, anyone out there with a superior quality of aluminum foil care to comment?

and as long as that was the case, Tim Negris would be pleased for the staying on
of message. But the litigation is such an albatross that you can say nothing of
SCO without mentioning it. It's even going to be mentioned by the real estate
agent selling their corporate HQ after they go bankrupt.

It's not so bad in the article proper, but the timeline beneath it really
hammers home how much about the litigation SCO is.

Also interesting is Bob Enderle's previously noted reversal of opinion. You
don't need a weatherman to know which way the wind blows.

is "Me Inc" actually illegal?

I'm sure everybody here will shocked to learn that scox's new business model may
actually be illegal. Supposedly, it's illegal to spam cell phones because they
are are owner pay.

I got this from a post on slashdot. Here it is:

Such messages violate the existing law, and the recepient is entitled to a
mandatory minimum of $500 per message.

Acacia Mortgage in Arizona tried this.. adn they are facing several million
dollars in court under the Telephone Consumer Protection Act [tcpalaw.com]
("TCPA"). It states at 47 USC 227(b):


* It shall be unlawful for any person within the United States or any person
outside the United States if the recipient is within the United States--
(A) to make any call (other than a call made for emergency purposes or made with
the prior express consent of the called party) using any automatic telephone
dialing system or an artificial or prerecorded voice--
(i) to any emergency telephone line (including any
``911'' line and any emergency line of a hospital, medical physician or service
office, health care facility, poison control center, or fire protection or law
enforcement agency);
(ii) to the telephone line of any guest room or patient room of a hospital,
health care facility, elderly home, or similar establishment; or
(iii) to any telephone number assigned to a paging service, cellular telephone
service, specialized mobile radio service, or other radio common carrier
service, or any
service for which the called party is charged for the call;


Joffee v. Acacia Nat'l Mtg. Corp., -- P.3d --, 2005 TCPA Rep 1381, 2005 WL
2303700 (Az. App, Sep 21, 2005) held that SMS messages to cell phones violated
this law. The court stated: "27 Here, Joffe received two SMS messages from
Acacia. Acacia used its computers to generate the messages and direct them to an
e-mail address provided to Joffe by his carrier that was made up of Joffe's ten
digit cellular telephone number and his cellular carrier's domain name. When
Acacia's solicitations reached Joffe's carrier, it converted them into SMS
messages and delivered them to Joffe's cellular telephone."

And in conclusion..." 49 By using an automatic dialing system to make
Internet-to-phone SMS calls to Joffe's cellular telephone, Acacia violated
227(b)(1)(A)(iii) of the TCPA"

An order from the FCC also said such messages violate the law.
