Hearing on Motions in Limine Changed to Sept. 11th in SCO v Novell
Wednesday, August 29 2007 @ 06:26 PM EDT

For those of you intending to attend the hearing on the motions in limine in SCO v. Novell, please note that there is a change of the date to September 11, so from Thursday to Tuesday. Here's the PACER entry:
409 - Filed & Entered: 08/29/2007
Notice of Hearing on Motion
Docket Text: AMENDED NOTICE OF HEARING ON MOTION (Notice generated by Kim Jones) Motion Hearing re: all motions in limine reset for 9/11/2007 10:00 AM in Room 220 before Judge Dale A. Kimball at the request of Heather Snedden, Esq. (kmj)

Note that these are just the motions in limine, about what the jury can hear. There are other outstanding motions of the regular variety that will be heard some other day, such as Novell's motion to strike SCO's jury demand.

I don't see SCO's Motion in Limine Regarding Apportionment of 2003 Microsoft and Sun Agreements [PDF; text] on the PACER list yet, but my guess is that it will be heard on September 11 as well, assuming they want to do the motions in limine all at one time. That's assuming no one files any more of them, which is a logical assumption since the deadline to file them was August 24.

September 11th it is, then, at 10 AM in Room 220. This is a good time to remind everyone that before you leave for the courthouse, it's wise to check to make sure there are no further changes. I'll put all the motions that will be heard that day here, so you can be ready for the hearing.

The motions heard that day will be:

Will Judge K. rule from the bench?

Is it possible that he has already made up his mind? If he doesn't rule from
the bench, can the trial start on time?

I am sorry to hear of this unfortunate change of date.

Many of us in the United States, feel this day should be declared a Federal
holiday, and a day of remembrance.
