More paperwork on the bills in the bankruptcy
Wednesday, February 13 2008 @ 12:22 AM EST

More boring applications for money from SCO, or certificates of no objection about bills to SCO, in the bankruptcy. This time it's Tanner and Dorsey lining up at the trough. Again. Like clockwork.

This is just paperwork, required by the court. So SCO can pay Dorsey $21,693.13 without need for a court order, due to no objections being filed; that's 80% of their bill and 100% of their expenses for November. And Tanner, the accountants, have filed their first quarterly application, covering the period of October 2, 2007 through January 4, 2008. They ask for $113,455.00 as compensation, plus $3,507.00 in expenses. That's the total for the bills already filed each month, and they say it represents 694.9 total hours, at a "blended" hourly rate of $163.27, which is certainly reasonable.

If SCO had an ongoing thriving business able to pay its bills, that is, it would be reasonable. As it is, the money they have left seems to be draining out bit by bit. To me, it's like if you don't have your rent money, but you go out and buy a new dress because it's on sale and hence a bargain.

I really can't wait for April to get here. The next deadline in Utah is now February 19, when Novell is due to respond to SCO's opposition to Novell's motion for summary judgment on its 4th claim. Judge Kimball signed the order giving them the extra stipulated time.

Here are all the filings:

340 - Filed & Entered: 02/12/2008
Certificate of No Objection
Docket Text: Certificate of No Objection (No Order Required) Regarding Second Interim Application Of Dorsey & Whitney LLP, Special Counsel To The Debtors And Debtors-In-Possession, For Compensation And Reimbursement Of Expenses For The Period November 1, 2007 Through November 30, 2007 (related document(s)[305] ) Filed by The SCO Group, Inc.. (Schnabel, Eric)

341 - Filed & Entered: 02/12/2008
Affidavit/Declaration of Service
Docket Text: Affidavit/Declaration of Service of the Certificate of No Objection (No Order Required) Regarding Second Interim Application Of Dorsey & Whitney LLP, Special Counsel To The Debtors And Debtors-In-Possession, For Compensation And Reimbursement Of Expenses For The Period November 1, 2007 Through November 30, 2007 (related document(s)[340] ) Filed by The SCO Group, Inc.. (Schnabel, Eric)

342 - Filed & Entered: 02/12/2008
Application for Compensation
Docket Text: Quarterly Application for Compensation (First) of Tanner LC for Services and Reimbursement of Expenses, as Accountants to the Debtors in Possession for the Period from October 2, 2007 through January 4, 2008 Filed by Tanner LC. Hearing scheduled for 3/7/2008 at 02:00 PM at US Bankruptcy Court, 824 Market St., 6th Fl., Courtroom #3, Wilmington, Delaware. Objections due by 3/3/2008. (Attachments: # (1) Notice # (2) Exhibit A # (3) Exhibit B # (4) Exhibit C # (5) Certificate of Service and Service List # (6) Certificate of Service and Service List (Notice Only)) (Werkheiser, Rachel)

And here's the docket entry from Utah District Court in SCO v. Novell:

493 -Filed: 02/08/2008
Entered: 02/11/2008
Order on Motion for Extension of Time to File Response/Reply Docket Text: ORDER granting [492] Motion for Extension of Time to File Response/Reply re [478] MOTION for Summary Judgment on Novell's Fourth Claim for Relief. Replies due by 2/19/2008. Signed by Judge Dale A. Kimball on 2/08/08. (jwt)
