SCO Files Monthly Operating Reports for June; Novell Statement

So. Do they have enough money to pay Novell? That is the question. You might want to compare this month's filings with the ones they filed last month.

Novell has issued a statement, as reported by the Daily Herald in Utah about the recent decision in the SCO v. Novell case:

"We think this is great news for Novell and for the open source community. We're very pleased this ruling reaffirms and strengthens Novell's ownership of the UNIX SVRX copyrights and vindicates Novell's continuing efforts to protect the open source community from SCO's claims," Novell said in Monday's statement.

"This ruling underlines the court's earlier decision, issued in August 2007, which found that Novell, not SCO, owns the copyrights to UNIX SVRX code, and further undermines SCO's claims against Linux users," according to the statement. "We see a pattern in the legal judgments made in this case: Decision after decision makes it clearer and clearer that SCO's legal claims against Linux have no merit."

The statement is up on Novell's site now too.

What happens in the bankruptcy if they SCO don't have money to pay Novell?

Do they? maybe. Will they? No. More bills will be paid before anything is
entered in Utah.

The balance sheet (page 11) and bank accounts statements (page 8) are very
interesting this month, especially the foreign cash. Net Foreign Cash went from
over $1 million last month into negative, including the $1.1 million they owe
Novell in SVRX licenses.

This should be some interesting reading. The bottom line for June is not bad,
as Mr. Spector represented to the court at the last hearing. But at first
glance, things might not be so rosy.

Damage control?

I am not 100% certain re: Novells comitment to Linux and Open Source. Not after
their deal with Microsoft.

They were not awareded as much dinero as they hade hoped for, and now try to
wring as much goodwill out of it as they can, by pointing out how much good they
have done to the Open Source community.
So I read this statement as 'damage control'.

PJ,

I know you're undoubtedly very busy with Groklaw already, but I have a request,
if you're game.

For folks like me who like to follow this saga through your page, but don't
really know how to interpret everything and know what's next, could you add a
section called something like "Next Steps" that outlines (and is
updated when appropriate) what your thoughts are on the future course of this
whole ridiculous play?

To a lot of the folks on this board, these things are fairly obvious, but to a
lot of us it's not really. It's not because we don't want to understand, it's
more that we either 1) don't have the experience to figure it out, or 2) don't
have the time to figure it out.

I know that in your articles you do try to do this, and there's always
speculation by many on what does actually come next, but if this could be
formalized in some small way that would be enormously helpful. Perhaps just
expand the existing timeline to also include speculation?

If and when may Novell terminate the SCOG's APA license to use and sell Unix
SVRX and/or Unixware for breach of contract? How does the SCOG bankruptcy affect
Novell's ability to terminate such agreements?
