Notice of Agenda for Friday's Bankruptcy Hearing - Gray Motion and AutoZone Sealing Objection |

So, what is on the agenda for Friday's hearing in the SCO bankruptcy? Several items are listed, but only two are contested.
The AutoZone settlement agreement received no written objections, but the U.S. Trustee's office does have an "informal" objection to the sealing of its terms. That means that will be at least discussed, unless they can get it resolved before Friday, and the Notice of Agenda says they're working on that. The U.S. Trustee's Office has been on the ball from the starting gate. The motion by Wayne Gray to lift the stay will also be argued at that hearing. SCO's Chapter 11 Trustee, Edward Cahn,
objected and Gray responded, so it's game on. The hearing should be pure fascination, to say the least. But I doubt the outcome is hard to guess.
The filings:

Cahn, Chapter 11 Trustee for The SCO Group, Inc., et al.. (Fatell, Bonnie) (Entered: 11/17/2009)
11/18/2009 - 967 - Notice of Agenda of Matters Scheduled for Hearing Filed by Edward N. Cahn, Chapter 11 Trustee for The SCO Group, Inc., et al.. Hearing scheduled for 11/20/2009 at 02:00 PM at US Bankruptcy Court, 824 Market St., 6th Fl., Courtroom #3, Wilmington, Delaware. (Fatell, Bonnie) (Entered: 11/18/2009)
11/18/2009 - 968 - Certificate of Service (related document(s) 966 ) Filed by Wayne R. Gray. (Duhig, Peter) (Entered: 11/18/2009)
No objections were filed against the retention of Boies Schiller or in regard to the motion by Pachulski Stang to quit representing SCO or about amending the monthly payment procedures for professionals. So it's buh bye Pachulski Stang. The hearing begins at 2 PM.

962 is signed by Judge Fross.
Will it even be brought up at the hearing?

So, does that mean the lift of the stay will probably be rejected?

I desperately need the comic relief!
I want to see how SCO victoriously frightened AutoZone into backing down on
SCO's overpowering claims. How AutoZone having obsolete libraries on its
servers caused SCO untold imaginable dollars in damages.
I want to hear how Cahn was desperately anxious to try AutoZone in court.
Or not.
I suspect SCO backed down like a frightened child. What I really want to know
is how much money was paid and by who. Who promised not to disclose the
weakness of the other party's claims. Etc.

It seems to me that the only reason that SCO needs to get the BK court to agree
to a settlement is that it involves money, in particular it requires SCO to pay
Autozone. So SCO need approval to add Autozone to the list of creditors, or more
likely, to pay directly.
If Autozone were paying SCO a settlement or there was no money involved either
way then would the BK court be needed to approve this ?

>Trustee's office does have an "informal" objection to the sealing
of its terms.
Well that interesting - thanks for that, it will be worth seeing if anything
comes of it.

What would an "informal" objection mean?
Is it just that you want to discuss the matter?
Why then discuss it in front of the court instead of directly between the
parties?
What rulings could come out of an "informal" objection?
Could the "informal" objection become a formal objection at the
hearing if the moving party do not come to terms with the other party?[ Reply to This | # ]

It occurred to me that scheduling this for 2:00 PM on a Friday means that no one
expects this to take very long.
