Novell and SCO Agree on April 19th for Filing Findings and Conclusions
Thursday, April 15 2010 @ 11:47 PM EDT

SCO and Novell have filed a joint motion, asking the court to order a new deadline for them to file their Proposed Findings of Fact and Conclusions of Law:
The parties have agreed to an extension of time until and including Monday, April 19, 2010, for filing their respective Proposed Findings of Fact and Conclusions of Law. This Motion respectfully request that the Court so order.
That is the complete text of the motion. The previous deadline for both of them to file was April 16, tomorrow, so this gives them the weekend to finish up.

Here is the motion:

03/08/2010 - 849 - **SEALED DOCUMENT** Jury Seating Arrangement. (slm) (Entered: 03/30/2010)

04/15/2010 - 850 - MOTION for Extension of Time for filing Proposed Findings of Fact and Conclusions of Law filed by Plaintiff SCO Group. (Hatch, Brent) (Entered: 04/15/2010)

You'll notice there is also a sealed document, evidently making a record of who was juror 1, 2, 3, etc. Here's a clue what lawyers might want such a chart for, "Practical Tools for Staying Organized during Voir Dire and Jury Selection" [PDF].

Update: And it is so ordered:

04/16/2010 - 851 - DOCKET TEXT ORDER granting 850 Motion for Extension of Time. Signed by Judge Ted Stewart on 4/16/2010. No attached document. (srs) (Entered: 04/16/2010)

Do lawyers only ever get things done at the last moment?!
In the grand scheme of things one more weekend is not much but you couldn't run
a business like this.

Curious - what to expect?

Will Judge Stewart take his cue about the final bits of this trial from these
proposed "findings" and "conclusions"? I remember that he
still has to rule on a legal matter that may "compel" Novell to hand
over copyrights. Will that be what is in these proposals?

Are these proposals likely to be in accord? That seems impossible, but anything
is possible in this case.

If Judge Stewart rules that there is no legal basis to compel Novell to hand
over copyrights, what happens to Novell's appeal to the SCOTUS?

one visit to Santa's lap coming up!

What do you think SCO will ask for? All the copyrights plus punitive damages
plus Novell's CEO's membership key to the SupahSekrit Successful HighTech
Executive Exclusive Club (Losers Keep Out!)
