Is this the Federal Court's way of telling the Delaware bankruptcy court that
it's not going to hear this turkey? And therefore that the BK court needs to
pull the plug on SCO, because it's not going to get a ruling that gives it
money, ever?

Sure, he presided over the second SCO v. Novell trial and ruled against SCO on
the matter of law issues, but he also made sure that SCO had every opportunity
to argue its case.
So if Dee Benson also recuses himself, Ted Stewart will do.

I guess being a living being person isn't so bad after all. This lingering death

Could this go back to Judge Kimball?
After the successful appeal in SCO v. Novell, I think the trial and final
rulings had to have a different judge, otherwise there would be obvious doubt
about whether the ruling was prejudged.
But now that Judge Kimball's judgement has been weighed against the jury verdict
and Judge Stewart's rulings, why shouldn't SCO v. IBM go back to him?[ Reply to This | # ]

Why is it not required that the Judge state the reason for the recusal?
How do we know that the reason is not "because I don't feel like it"
(which by the way, is probably a valid reason in this case, but that's besides
