Can you believe it?
12/14/2011 - 1104 - ORDER OF RECUSAL Judge David Sam recused. Case reassigned to Judge Dee Benson for all further proceedings. Signed by Judge David Sam on 12/13/11. (jmr) (Entered: 12/14/2011)

Judge David Sam joins a flock of judges who have now recused themselves from this case. And it would surprise me if Judge Benson doesn't have to do the same, given his friendship with Senator Orrin Hatch, father of SCO's lawyer, Brent Hatch. Who's left? Judge Ted Stewart?

Keep recycling the case until there are no eligible judges to hear it.

I.E. delay.

Is this the Federal Court's way of telling the Delaware bankruptcy court that
it's not going to hear this turkey? And therefore that the BK court needs to
pull the plug on SCO, because it's not going to get a ruling that gives it
money, ever?

Sure, he presided over the second SCO v. Novell trial and ruled against SCO on
the matter of law issues, but he also made sure that SCO had every opportunity
to argue its case.

So if Dee Benson also recuses himself, Ted Stewart will do.

No captial offense for corporations

I guess being a living being person isn't so bad after all. This lingering death
thing for the likes of SCO warms my heart. There should be a word for taking
pleasure in the misfortune of corporations.

Back to Judge Kimball?

Could this go back to Judge Kimball?

After the successful appeal in SCO v. Novell, I think the trial and final
rulings had to have a different judge, otherwise there would be obvious doubt
about whether the ruling was prejudged.

But now that Judge Kimball's judgement has been weighed against the jury verdict
and Judge Stewart's rulings, why shouldn't SCO v. IBM go back to him?

The way this punch and judy show is playing out, I thoroughly expect him to
invite Brent to sit at the bench with him as "you get a better view from up
here" etc

Reasons for recusal?

Why is it not required that the Judge state the reason for the recusal?

How do we know that the reason is not "because I don't feel like it"
(which by the way, is probably a valid reason in this case, but that's besides
the point)?
